Problemele tehnice de rutin\u0103 sunt, \u00een general, considerate inerente.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>S\u0103 se afle \u00een afara controlului efectiv al transportatorului<\/b><span style=\"font-weight: 400;\"> \u2013 evenimentul trebuie s\u0103 provin\u0103 din afara sferei de control a transportatorului, de exemplu fapte ale ter\u021bilor, fenomene naturale sau defecte ascunse.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Dac\u0103 ambele condi\u021bii sunt \u00eendeplinite \u0219i transportatorul demonstreaz\u0103 c\u0103 a luat toate m\u0103surile rezonabile, compensa\u021bia poate s\u0103 nu fie datorat\u0103.<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-2 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2><strong> 2. Defec\u021biuni tehnice \u00een operarea aeronavei<\/p>\n<p><\/strong><\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-3\"><h3>Probleme de \u00eentre\u021binere de rutin\u0103<\/h3>\n<p><span style=\"font-weight: 400;\">\u00cen cauza <\/span><a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=DC2A762AD0A159E5B5ED444F540A3E49?text=&amp;docid=73223&amp;pageIndex=0&amp;doclang=RO&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=6778171\" target=\"_blank\" rel=\"noopener\"><b>Wallentin-Hermann \u00eempotriva Alitalia (C-549\/07)<\/b><\/a><span style=\"font-weight: 400;\">, Curtea a constatat c\u0103 problemele tehnice descoperite \u00een timpul \u00eentre\u021binerii sau cauzate de lipsa \u00eentre\u021binerii nu sunt excep\u021bionale. Func\u021bionarea unei aeronave produce inevitabil probleme tehnice, iar transportatorii sunt a\u0219tepta\u021bi s\u0103 le anticipeze \u0219i s\u0103 le gestioneze. \u00cen mod similar, \u00een cauza <\/span><a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=167942&amp;pageIndex=0&amp;doclang=RO&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=6778606\" target=\"_blank\" rel=\"noopener\"><b>van der Lans \u00eempotriva KLM (C-257\/14)<\/b><\/a><span style=\"font-weight: 400;\">, Curtea a statuat c\u0103 <\/span><b>defectarea prematur\u0103 a unor componente<\/b><span style=\"font-weight: 400;\">, chiar \u0219i atunci c\u00e2nd este nea\u0219teptat\u0103, r\u0103m\u00e2ne intrinsec legat\u0103 de sistemul de operare al aeronavei; astfel de defec\u021biuni sunt considerate de rutin\u0103 \u0219i se afl\u0103 \u00een sfera de control a companiei aeriene. Doar defectele sistemice care afecteaz\u0103 o \u00eentreag\u0103 flot\u0103 ar putea fi calificate ca excep\u021bionale.<\/span><\/p>\n<h3>Defectarea pieselor \u201eon-condition\u201d (2020 \u2013 C-832\/18)<\/h3>\n<p><span style=\"font-weight: 400;\">O <\/span><b>pies\u0103 \u201eon-condition\u201d<\/b><span style=\"font-weight: 400;\"> este \u00eenlocuit\u0103 doar atunci c\u00e2nd devine defect\u0103. \u00cen cauza <\/span><a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf?text=&amp;docid=224383&amp;pageIndex=0&amp;doclang=RO&amp;mode=lst&amp;dir=&amp;occ=first&amp;part=1&amp;cid=6779938\" target=\"_blank\" rel=\"noopener\"><b>A \u0219i al\u021bii \u00eempotriva<\/b><b> <\/b><b>Finnair Oyj (C-832\/18)<\/b><\/a><span style=\"font-weight: 400;\">, CJUE a statuat c\u0103 defectarea unei astfel de piese face parte, \u00een principiu, din func\u021bionarea normal\u0103 a aeronavei \u0219i nu poate justifica neplata compensa\u021biei. Curtea a re\u021binut c\u0103 un transportator nu se poate prevala de \u00eemprejur\u0103ri excep\u021bionale care decurg din defectarea unei piese \u201eon-condition\u201d, cu excep\u021bia cazului \u00een care defectarea <\/span><b>nu este inerent\u0103 func\u021bion\u0103rii normale \u0219i se afl\u0103 \u00een afara controlului s\u0103u<\/b><span style=\"font-weight: 400;\">. \u00centruc\u00e2t defectarea este intrinsec legat\u0103 de sistemul de operare al aeronavei, aceasta nu reprezint\u0103, de regul\u0103, un eveniment excep\u021bional.<\/span><\/p>\n<h3><b>Defecte ascunse de proiectare (2024 \u2013 C-385\/23)<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">\u00cen cauza <\/span><a href=\"https:\/\/curia.europa.eu\/juris\/document\/document.jsf;jsessionid=B573E7857BADB5784957572C2E33900F?text=&amp;docid=287074&amp;pageIndex=0&amp;doclang=RO&amp;mode=req&amp;dir=&amp;occ=first&amp;part=1&amp;cid=3527055\" target=\"_blank\" rel=\"noopener\"><b>Matkustaja A \u00eempotriva Finnair Oyj (C-385\/23)<\/b><\/a><span style=\"font-weight: 400;\">, pronun\u021bat\u0103 la <\/span><b>13 iunie 2024<\/b><span style=\"font-weight: 400;\">, Curtea a examinat un zbor anulat din cauza defect\u0103rii indicatorului de combustibil al unei aeronave noi. Defectul a fost prima defec\u021biune cunoscut\u0103 a respectivei componente, iar investiga\u021biile ulterioare au relevat un <\/span><b>viciu latent de proiectare<\/b><span style=\"font-weight: 400;\"> care afecta toate aeronavele de acela\u0219i model. CJUE a reiterat c\u0103 defec\u021biunile tehnice sunt, \u00een general, inerente activit\u0103\u021bii unei companii aeriene, dar a acceptat c\u0103 <\/span><b>defectele ascunse de fabrica\u021bie sau proiectare<\/b><span style=\"font-weight: 400;\"> pot constitui \u00eemprejur\u0103ri excep\u021bionale dac\u0103:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Produc\u0103torul sau o autoritate competent\u0103 confirm\u0103 c\u0103 defec\u021biunea a fost <\/span><b>nea\u0219teptat\u0103 \u0219i f\u0103r\u0103 precedent<\/b><span style=\"font-weight: 400;\"> \u0219i afecteaz\u0103 <\/span><b>toate aeronavele de acela\u0219i tip<\/b><span style=\"font-weight: 400;\">;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Defectul <\/span><b>afecteaz\u0103 siguran\u021ba zborului<\/b><span style=\"font-weight: 400;\">, neoferindu-i transportatorului o ocazie rezonabil\u0103 de a preveni sau atenua defec\u021biunea.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Atunci c\u00e2nd sunt \u00eendeplinite aceste criterii, evenimentul este considerat extern controlului companiei aeriene \u0219i neinerent activit\u0103\u021bii sale normale, permi\u021b\u00e2nd transportatorului s\u0103 evite plata compensa\u021biei. Aceast\u0103 hot\u0103r\u00e2re este semnificativ\u0103 deoarece ofer\u0103 o defini\u021bie mai clar\u0103 a defectelor ascunse \u0219i demonstreaz\u0103 c\u0103 ap\u0103rarea bazat\u0103 pe \u00eemprejur\u0103ri excep\u021bionale poate fi aplicabil\u0103 <\/span><b>viciilor de proiectare<\/b><span style=\"font-weight: 400;\"> aflate \u00een afara controlului transportatorului.<\/span><\/p>\n<h3>Evenimente externe \u0219i alte exemple<\/h3>\n<p><span style=\"font-weight: 400;\">Curtea distinge \u00eentre <\/span><b>evenimentele interne<\/b><span style=\"font-weight: 400;\">, care decurg din propriile opera\u021biuni ale companiei aeriene, \u0219i <\/span><b>evenimentele externe<\/b><span style=\"font-weight: 400;\">, care implic\u0103 ter\u021bi sau fenomene naturale. Doar evenimentele externe se pot califica drept \u00eemprejur\u0103ri excep\u021bionale. Exemple importante includ:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Greve s\u0103lbatice<\/b><span style=\"font-weight: 400;\">: grevele organizate de proprii angaja\u021bi ai unei companii aeriene ca r\u0103spuns la restructurare sau la conflicte de munc\u0103 nu sunt excep\u021bionale; companiile aeriene r\u0103m\u00e2n obligate la plata compensa\u021biei. \u00cen schimb, grevele <\/span><b>controlorilor de trafic aerian<\/b><span style=\"font-weight: 400;\"> sau ale <\/span><b>personalului aeroportuar<\/b><span style=\"font-weight: 400;\"> pot fi calificate ca excep\u021bionale deoarece provin din afara transportatorului.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Coliziuni cu p\u0103s\u0103ri<\/b><span style=\"font-weight: 400;\">: o coliziune cu o pas\u0103re este considerat\u0103 o \u00eemprejurare excep\u021bional\u0103. Totu\u0219i, transportatorul nu poate justifica o \u00eent\u00e2rziere suplimentar\u0103 prin efectuarea unei a doua verific\u0103ri odat\u0103 ce un expert autorizat a constatat c\u0103 aeronava este apt\u0103 de zbor.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Coliziuni cu echipamente aeroportuare<\/b><span style=\"font-weight: 400;\">: daunele cauzate de coliziunea unei sc\u0103ri mobile a aeroportului cu o aeronav\u0103 nu sunt excep\u021bionale, \u00eentruc\u00e2t serviciile de handling la sol fac parte din opera\u021biunile normale ale companiei aeriene.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Obiecte str\u0103ine pe piste<\/b><span style=\"font-weight: 400;\">: deteriorarea anvelopelor din cauza unor resturi sau \u00eenchiderea unei piste din cauza scurgerilor de carburant de la o alt\u0103 aeronav\u0103 sunt evenimente externe \u0219i pot constitui \u00eemprejur\u0103ri excep\u021bionale.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Pasageri turbulen\u021bi<\/b><span style=\"font-weight: 400;\">: devierea unui zbor pentru debarcarea unui pasager perturbator poate constitui o \u00eemprejurare excep\u021bional\u0103, cu excep\u021bia cazului \u00een care compania aerian\u0103 a contribuit la situa\u021bie sau nu a ac\u021bionat \u00een baza unor indicii prealabile.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Catastrofe naturale<\/b><span style=\"font-weight: 400;\">: erup\u021biile vulcanice, precum erup\u021bia Eyjafjallaj\u00f6kull care a dus la \u00eenchiderea spa\u021biului aerian, sunt excep\u021bionale, dar nu \u00eel scutesc pe transportator de obliga\u021bia de a oferi \u00eengrijire, conform articolelor 5 alineatul (1) litera (b) \u0219i 9.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Curtea a clarificat, de asemenea, c\u0103 atunci c\u00e2nd o \u00eemprejurare excep\u021bional\u0103 survine la un <\/span><b>zbor anterior care a utilizat aceea\u0219i aeronav\u0103<\/b><span style=\"font-weight: 400;\">, transportatorul se poate prevala de evenimentul respectiv doar dac\u0103 exist\u0103 o leg\u0103tur\u0103 direct\u0103 de cauzalitate cu \u00eent\u00e2rzierea ulterioar\u0103.<\/span><\/p>\n<\/div><div class=\"fusion-title title fusion-title-3 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2>3. M\u0103suri rezonabile \u0219i obliga\u021biile transportatorului<\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-4\"><p><span style=\"font-weight: 400;\">Chiar \u0219i atunci c\u00e2nd exist\u0103 o \u00eemprejurare excep\u021bional\u0103, transportatorii trebuie s\u0103 demonstreze c\u0103 au luat <\/span><b>toate m\u0103surile rezonabile<\/b><span style=\"font-weight: 400;\"> pentru evitarea sau atenuarea \u00eent\u00e2rzierii. Curtea a explicat c\u0103 companiile aeriene trebuie s\u0103 \u00ee\u0219i planifice zborurile cu o <\/span><b>marj\u0103 rezonabil\u0103 de timp de rezerv\u0103<\/b><span style=\"font-weight: 400;\"> pentru a face fa\u021b\u0103 \u00eentreruperilor nea\u0219teptate, dar nu li se cere s\u0103 fac\u0103 sacrificii intolerabile. Dac\u0103 un transportator nu utilizeaz\u0103 resursele disponibile (personal sau echipamente), poate fi \u00een continuare obligat la plata compensa\u021biei.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Important: \u00eemprejur\u0103rile excep\u021bionale nu \u00eel scutesc pe transportator de obliga\u021bia de a oferi <\/span><b>\u00eengrijire \u0219i asisten\u021b\u0103<\/b><span style=\"font-weight: 400;\">, precum mese, cazare \u0219i rerutare; acestea afecteaz\u0103 doar plata compensa\u021biei pecuniare.
