Aceast\u0103 directiv\u0103 este transpus\u0103 \u00een legisla\u021bia na\u021bional\u0103 prin <a href=\"https:\/\/arhiva.anre.ro\/ro\/legislatie\/legi\/energie-electrica\" target=\"_blank\" rel=\"noopener\">Legea energiei electrice \u0219i a gazelor naturale nr. 123\/2012<\/a> \u0219i prin diverse reglement\u0103ri secundare emise de Autoritatea Na\u021bional\u0103 de Reglementare \u00een domeniul Energiei (ANRE).<\/p>\n<p>Ecosistemul institu\u021bional are o configurare pe mai multe niveluri:<\/p>\n<ul>\n<li><strong>ANRE<\/strong> supravegheaz\u0103 reglementarea, licen\u021bierea \u0219i monitorizarea produc\u0103torilor de energie electric\u0103 \u0219i a operatorilor de re\u021bea.<\/li>\n<li><strong>Operatorul de transport \u0219i de sistem (Transelectrica)<\/strong> \u0219i <strong>operatorii de distribu\u021bie (OD)<\/strong> sunt responsabili pentru racordarea la re\u021bea, avizele tehnice \u0219i alocarea capacit\u0103\u021bii.<\/li>\n<li><strong>Autorit\u0103\u021bile locale<\/strong> (prim\u0103rii \u0219i consilii jude\u021bene) gestioneaz\u0103 urbanismul \u0219i autorizarea construirii.<\/li>\n<li><strong>Agen\u021biile pentru protec\u021bia mediului<\/strong> (APM\/ANPM) supravegheaz\u0103 evalu\u0103rile \u0219i autoriz\u0103rile de mediu.<\/li>\n<li><strong>Inspectoratul General pentru Situa\u021bii de Urgen\u021b\u0103 (IGSU)<\/strong> acord\u0103 avizele de securitate la incendiu.<\/li>\n<\/ul>\n<p>Av\u00e2nd \u00een vedere aceast\u0103 complexitate institu\u021bional\u0103, gestionarea reglement\u0103rilor presupune adesea o coordonare juridic\u0103 \u0219i tehnic\u0103 transdisciplinar\u0103.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-2 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2><strong> 2. Tipologia proiectelor solare<\/strong><\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-3\"><p>Procedura de licen\u021biere variaz\u0103 semnificativ \u00een func\u021bie de amploarea \u0219i natura proiectului fotovoltaic (PV). Rom\u00e2nia recunoa\u0219te trei categorii principale:<\/p>\n<ul>\n<li><strong>Proiecte de prosumator (\u2264400 kW)<\/strong>: sunt, de regul\u0103, sisteme reziden\u021biale sau comerciale mici, montate pe acoperi\u0219. Cadrul de reglementare pentru prosumatori este semnificativ simplificat, pentru a \u00eencuraja adoptarea pe scar\u0103 larg\u0103.<\/li>\n<li><strong>Proiecte la scar\u0103 comercial\u0103 (400 kW \u2013 1 MW)<\/strong>: aceste sisteme, adesea instalate pe spa\u021bii comerciale sau industriale, sunt supuse unui nivel intermediar de control.<\/li>\n<li><strong>Proiecte la scar\u0103 de utilitate (&gt;1 MW)<\/strong>: aceste proiecte, care pot dep\u0103\u0219i 100 MW, sunt supuse unor proceduri cuprinz\u0103toare de autorizare \u0219i coordonare la nivelul re\u021belei. Acestea implic\u0103 frecvent provoc\u0103ri legate de utilizarea terenului, de analizele de mediu \u0219i de capacitatea re\u021belei.<\/li>\n<\/ul>\n<p>Fiecare categorie atrage o combina\u021bie distinct\u0103 de cerin\u021be juridice, praguri de reglementare \u0219i sarcini administrative.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-3 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2>3. <strong>Achizi\u021bia terenului \u0219i urbanismul<\/strong><\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-4\"><p>Prima provocare juridic\u0103 pentru proiectele montate pe sol o reprezint\u0103 \u00eencadrarea terenului \u0219i conformitatea cu reglement\u0103rile de urbanism. Dezvoltatorii trebuie s\u0103 efectueze un proces minu\u021bios de due diligence asupra statutului terenului:<\/p>\n<ul>\n<li><strong>Clasificarea terenului<\/strong>: terenurile agricole, \u00een special cele cu fertilitate ridicat\u0103 (clasele I\u2013III), nu pot fi utilizate pentru infrastructur\u0103 energetic\u0103 f\u0103r\u0103 scoaterea prealabil\u0103 din circuitul agricol, care trebuie autorizat\u0103 de Ministerul Agriculturii. Scoaterea din circuitul agricol este \u00eempov\u0103r\u0103toare din punct de vedere administrativ \u0219i sensibil\u0103 la termene.<\/li>\n<li><strong>Certificat de urbanism<\/strong>: acest document, emis de autoritatea local\u0103 competent\u0103, precizeaz\u0103 dac\u0103 utilizarea propus\u0103 este conform\u0103 cu planurile de urbanism \u0219i prezint\u0103 avizele necesare pentru dezvoltarea proiectului.<\/li>\n<li><strong>Plan urbanistic zonal (PUZ)<\/strong>: dac\u0103 terenul nu este deja \u00eencadrat ca destinat infrastructurii energetice, PUZ este obligatoriu. Acest instrument de urbanism necesit\u0103 consultarea p\u0103r\u021bilor interesate, evaluare de mediu (dac\u0103 este cazul) \u0219i poate prelungi termenele proiectului cu 6\u201312 luni.<\/li>\n<\/ul>\n<p>\u00cen mod notabil, neasigurarea unei \u00eencadr\u0103ri urbanistice corespunz\u0103toare este o cauz\u0103 frecvent\u0103 a \u00eent\u00e2rzierilor proiectelor \u0219i a frustr\u0103rii investitorilor. Implicarea juridic\u0103 din faza de achizi\u021bie a terenului este, prin urmare, esen\u021bial\u0103.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-4 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2>4. <strong> Autoriz\u0103rile de mediu \u0219i de construire<\/strong><\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-5\"><p>Conformitatea de mediu este o alt\u0103 component\u0103 esen\u021bial\u0103 a lan\u021bului de autoriz\u0103ri:<\/p>\n<ul>\n<li><strong>Aviz de mediu<\/strong>: proiectele de peste 1 MW sau cele situate \u00een arii sensibile din punct de vedere ecologic trebuie s\u0103 parcurg\u0103 procedura evalu\u0103rii impactului asupra mediului (EIM). Procesul include consult\u0103ri publice \u0219i poate declan\u0219a studii suplimentare de biodiversitate sau evalu\u0103ri de impact cumulativ.<\/li>\n<li><strong>Aviz IGSU<\/strong>: instala\u021biile montate pe sol \u0219i sistemele mai mari montate pe acoperi\u0219 trebuie s\u0103 ob\u021bin\u0103 avizul IGSU pe baza unor planuri tehnice detaliate, \u00een special privind sistemele de prevenire a incendiilor \u0219i c\u0103ile de acces pentru vehiculele de interven\u021bie.<\/li>\n<li><strong>Aviz sanitar<\/strong>: pentru instala\u021biile aflate \u00een apropierea unor obiective sensibile (de exemplu, \u0219coli, spitale), direc\u021bia jude\u021bean\u0103 de s\u0103n\u0103tate public\u0103 poate solicita avize sanitare suplimentare.<\/li>\n<li><strong>Autoriza\u021bie de construire<\/strong>: aceasta se emite pe baza unei documenta\u021bii tehnice complete, incluz\u00e2nd documenta\u021bia de arhitectur\u0103, structural\u0103 \u0219i de mediu. Chiar \u0219i instala\u021biile minore montate pe acoperi\u0219 sunt supuse autoriz\u0103rii, dac\u0103 presupun modific\u0103ri structurale.<\/li>\n<\/ul>\n<p>Reformele recente au eliminat cerin\u021ba autoriza\u021biei de construire pentru anumite sisteme de prosumator instalate pe structuri existente, f\u0103r\u0103 modificarea elementelor portante \u2013 o simplificare binevenit\u0103.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-5 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2>5. Racordarea la re\u021bea: aspecte tehnice \u0219i juridice<\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-6\"><p>Asigurarea accesului la re\u021beaua de transport sau de distribu\u021bie este una dintre cele mai critice \u2013 \u0219i competitive \u2013 etape ale procesului de dezvoltare a proiectului:<\/p>\n<ul>\n<li><strong>Cerere de racordare<\/strong>: procesul \u00eencepe cu depunerea unei cereri oficiale c\u0103tre operatorul de re\u021bea competent (OD sau Transelectrica, \u00een func\u021bie de capacitate \u0219i de amplasament).<\/li>\n<li><strong>Avizul tehnic de racordare (ATR)<\/strong>: acest document este emis \u00een urma unui studiu de solu\u021bie privind racordarea la re\u021bea \u0219i specific\u0103 condi\u021biile tehnice \u0219i financiare ale interconect\u0103rii. Acesta include adesea cerin\u021be privind posturi de transformare sau echipamente de compensare.<\/li>\n<li><strong>Contract de racordare<\/strong>: odat\u0103 ce ATR este acceptat, dezvoltatorul trebuie s\u0103 \u00eencheie un contract de racordare obligatoriu \u00eentr-un termen specific.<\/li>\n<li><strong>Lucr\u0103rile de racordare \u0219i punerea \u00een func\u021biune<\/strong>: lucr\u0103rile de re\u021bea pot fi executate fie de dezvoltator (dac\u0103 este autorizat), fie de operatorul de re\u021bea. La finalizare \u0219i dup\u0103 verificare, se emite un <strong>certificat de racordare<\/strong>, care confirm\u0103 interconectarea fizic\u0103 a centralei.<\/li>\n<\/ul>\n<p>Accesul la re\u021bea se confrunt\u0103 tot mai des cu blocaje \u00een regiunile cu cerere mare. Pentru a aborda acest aspect, Rom\u00e2nia se preg\u0103te\u0219te s\u0103 implementeze <strong>licita\u021bii pentru capacitatea re\u021belei<\/strong> pentru proiectele de peste 5 MW, \u00eencep\u00e2nd cu 2026. Consilierul juridic ar trebui s\u0103 monitorizeze \u00eendeaproape reglement\u0103rile privind accesul la re\u021bea, \u00eentruc\u00e2t modific\u0103rile pot influen\u021ba bancabilitatea \u0219i calendarul proiectului.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-6 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2>6. <strong>Licen\u021bierea de c\u0103tre ANRE<\/strong><\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-7\"><p>Licen\u021bierea ANRE asigur\u0103 supravegherea reglementar\u0103 a produc\u0103torilor de energie electric\u0103 \u0219i a participan\u021bilor la pia\u021b\u0103. Exist\u0103 mai mul\u021bi pa\u0219i esen\u021biali:<\/p>\n<ul>\n<li><strong>Certificarea tehnic\u0103 a instala\u021biei<\/strong>: \u00eenainte de exploatarea comercial\u0103, instala\u021biile trebuie certificate de o entitate autorizat\u0103 de ANRE pentru a verifica conformitatea cu normele tehnice \u0219i cu cerin\u021bele de siguran\u021b\u0103.<\/li>\n<li><strong>Licen\u021ba pentru exploatare comercial\u0103<\/strong>: aceasta este licen\u021ba-cheie de reglementare, valabil\u0103 timp de 25 de ani, care autorizeaz\u0103 producerea \u0219i v\u00e2nzarea de energie electric\u0103 \u00een re\u021bea. Aceasta necesit\u0103 dovada legalit\u0103\u021bii, a capacit\u0103\u021bii tehnice \u0219i a solvabilit\u0103\u021bii financiare.<\/li>\n<li><strong>\u00cenregistrarea pe pia\u021b\u0103<\/strong>: dezvoltatorii trebuie, de asemenea, s\u0103 se \u00eenregistreze la operatorul pie\u021bei centralizate (OPCOM) \u0219i la Transelectrica pentru serviciile de echilibrare. \u00cen func\u021bie de strategia de tranzac\u021bionare (de exemplu, contracte bilaterale, ziua-pentru-ziua, echilibrare), pot fi necesare \u00eenregistr\u0103ri suplimentare.<\/li>\n<\/ul>\n<p>De re\u021binut, prosumatorii sub 400 kW sunt scuti\u021bi de cerin\u021ba licen\u021bei de exploatare comercial\u0103 \u0219i beneficiaz\u0103 de proceduri simplificate de integrare pe pia\u021b\u0103.<\/p>\n<\/div><div class=\"fusion-title title fusion-title-7 fusion-sep-none fusion-title-text fusion-title-size-three\" style=\"--awb-margin-top:50px;\"><h3 class=\"fusion-title-heading title-heading-left\" style=\"margin:0;\"><h2>7. <strong>Scheme de sprijin \u0219i regimuri speciale<\/strong><\/h2><\/h3><\/div><div class=\"fusion-text fusion-text-8\"><p>Rom\u00e2nia a introdus progresiv mecanisme de sprijin pentru implementarea energiei din surse regenerabile:<\/p>\n<ul>\n<li><strong>Prosumatori<\/strong>: ace\u0219tia beneficiaz\u0103 de mecanisme de net metering, scutiri de TVA (pentru persoane fizice) \u0219i de garan\u021bii de cump\u0103rare din partea furnizorilor la pre\u021buri reglementate de ANRE.<\/li>\n<li><strong>Contracte pentru diferen\u021b\u0103 (CfD)<\/strong>: prima schem\u0103 CfD din Rom\u00e2nia a fost lansat\u0103 \u00een 2024, oferind stabilitate pe termen lung a pre\u021burilor pentru proiectele solare \u0219i eoliene. Dezvoltatorii trebuie s\u0103 c\u00e2\u0219tige licita\u021bii competitive \u0219i s\u0103 \u00eencheie contracte CfD cu contrapartea desemnat\u0103.<\/li>\n<li><strong>Comunit\u0103\u021bi de energie<\/strong>: sunt \u00een curs ini\u021biative legislative pentru promovarea propriet\u0103\u021bii colective asupra instala\u021biilor regenerabile prin cooperative energetice \u0219i comunit\u0103\u021bi de energie ale cet\u0103\u021benilor. Acest lucru va deschide noi oportunit\u0103\u021bi pentru produc\u021bia descentralizat\u0103 de energie, cu modele de guvernan\u021b\u0103 partajat\u0103.<\/li>\n<li><strong>Stocare obligatorie<\/strong>: \u00eencep\u00e2nd cu 2027, prosumatorii cu sisteme \u00eentre 10,8 kW \u0219i 400 kW trebuie s\u0103 integreze stocare \u00een baterii.
